The license that covers the Pick Me Pets app.

This End User License Agreement ("EULA") is a legal agreement between you and Technection, LLC, a Texas limited liability company, doing business as Pick Me Pets ("Pick Me Pets," "we," "us," or "our"), governing your download, installation, and use of the Pick Me Pets mobile application (the "App") on any device you own or control.

This EULA governs the App specifically. Your use of the App is also governed by the Pick Me Pets Terms of Service (the "Terms") and Privacy Policy, also available in the app under Account → Legal, which are incorporated into this EULA by reference and govern all substantive matters not addressed here — including the Buyer Protection Fee, deposits and payments, contact masking, the E-Signature Feature, disclaimers, limitation of liability, indemnification, and the arbitration agreement and class action waiver. If this EULA conflicts with the Terms on a matter the Terms address, the Terms control; on matters specific to the App as installed software (Sections 1–6 below), this EULA controls. BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU AGREE TO BE BOUND BY THIS EULA AND THE TERMS. IF YOU DO NOT AGREE, DO NOT DOWNLOAD, INSTALL, OR USE THE APP.

Subject to your compliance with this EULA and the Terms, Pick Me Pets grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use one copy of the App on a mobile device that you own or control, solely for your own personal, non-commercial use, and solely in the form made available through the Apple App Store or Google Play. You may not: copy, modify, or create derivative works of the App; reverse engineer, decompile, or disassemble the App, except to the extent applicable law expressly permits; rent, lease, lend, sell, redistribute, or sublicense the App; remove or obscure any proprietary notices; or use the App for any purpose not expressly permitted by this EULA and the Terms. All rights not expressly granted are reserved by Pick Me Pets and its licensors.

If you obtained the App from the Apple App Store, the following additional terms apply, and in the event of any conflict, these terms control over the rest of this EULA solely with respect to the matters they address:

2.1 Acknowledgment

This EULA is between you and Pick Me Pets only, not Apple Inc. ("Apple"), and Apple is not a party to this EULA. Pick Me Pets, not Apple, is solely responsible for the App and its content.

2.2 Scope of license

Your license to use the App is limited to a non-transferable license to use the App on any Apple-branded product that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing, where applicable.

2.3 Maintenance and support

Pick Me Pets, not Apple, is solely responsible for providing any maintenance and support services with respect to the App, as further described in the Terms. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

2.4 Warranty

Pick Me Pets is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Pick Me Pets's sole responsibility.

2.5 Product claims

Pick Me Pets, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

2.6 Intellectual property claims

In the event of any third-party claim that the App, or your possession and use of the App, infringes that third party's intellectual property rights, as between Pick Me Pets and Apple, Pick Me Pets, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim to the extent required by this EULA.

2.7 Legal compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

2.8 Developer contact

2.9 Third-party beneficiary

You and Pick Me Pets acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary of it.

If you obtained the App from Google Play, your use is also subject to the then-current Google Play Terms of Service. Google is not a party to this EULA and has no obligation or liability to you with respect to the App. As between Pick Me Pets and Google, Pick Me Pets is solely responsible for the App and its content.

We may release updates, patches, or new versions of the App from time to time, which may be required for continued use of the App and may be installed automatically depending on your device settings. This EULA applies to all updates unless a separate license accompanies an update.

The App may request access to certain device features and data, including your camera and photo library (to upload photos, such as for reviews or verification), microphone and camera for video calls with breeders, location (to support "near me" search and distance-based results, where offered), and push notification delivery. You may grant or deny each permission through your device settings; declining a permission may limit related App functionality. Our collection and use of information gathered through these permissions is described in our Privacy Policy.

With your permission, the App may send push notifications for message alerts, deposit and transaction confirmations, new or matching listing alerts, and — where you separately opt in — promotional content. You may disable push notifications at any time in your device settings or in the App's notification preferences. Push notification consent is independent of, and does not substitute for, the SMS and email consent described in the Terms.

This EULA is effective until terminated. It terminates automatically if you fail to comply with its terms, or upon uninstallation of the App. Pick Me Pets may also terminate this EULA as described in the Terms. Upon termination, you must cease all use of the App and delete all copies from your devices. Section 2 and the incorporated provisions of the Terms that by their nature should survive termination will survive.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." THE DISCLAIMERS, LIMITATION OF LIABILITY, RELEASE, AND INDEMNIFICATION PROVISIONS SET FORTH IN THE TERMS APPLY IN FULL TO THE APP AND ARE INCORPORATED INTO THIS EULA BY REFERENCE.

This EULA is governed by the laws of the State of Texas, consistent with the Terms. Any dispute arising out of or relating to this EULA is subject to the arbitration agreement, class action waiver, and mass action waiver set forth in the Terms, which are incorporated into this EULA by reference.
